Terms of Service

These terms explain how DearEver accepts, creates, reviews, and delivers personalized stories.

1. The service

DearEver is a done-for-you creative service. You provide the memories, writing, dates, and photographs; we curate and design an interactive story for the person and occasion you specify. An intake submission is a request for review, not an acceptance of an order or a promise that we can meet every requested date.

2. Packages and payment

Birthday and Anniversary Stories are paid in full before work begins. Custom Stories use a 50% booking deposit, with the balance due after preview approval and before publication. Checkout is provided by a third-party payment processor when enabled; DearEver does not store full card numbers. The price, scope, and payment schedule shown at checkout or in an accepted quote control that order. Submitting the current intake does not charge you or begin paid production.

3. Photo & content rights

You are responsible for the accuracy of names, dates, and instructions and for having the right to share every photo, video, recording, and written item. By submitting content, you confirm that:

  • You own it or have permission from the owner to share it for this purpose.
  • You have the permission needed from people shown or named in it, including a parent or guardian's permission where a child is involved.
  • It does not infringe copyright, privacy, or another person's rights.
  • It is not unlawful, abusive, hateful, sexually explicit, or malicious.

You keep ownership of your submitted content and grant DearEver a limited, non-exclusive permission to store, edit, and use it only to scope, design, build, review, host, and support the story you requested. DearEver does not independently verify ownership of every submitted item. We do not sell or independently license customer content or authorize service providers to use it for unrelated purposes.

If submitted content includes a child, you confirm that you are the child's parent or guardian or have the appropriate permission to submit it.

We may decline or pause an order that creates a legal, safety, or practical problem. If you believe content should not have been shared, email support@dear-ever.com with the order reference so we can review it.

4. Timeline and delivery

A preview timeline begins only after required payment and complete, usable content are received. Birthday and Anniversary Stories have a three-business-day first-preview target; Custom Stories have a seven-business-day target. These are targets, not guarantees, and a close event date should be disclosed before payment. Delivery includes an unlisted link and one QR code. You are responsible for keeping access to the purchaser email and for sharing the final link carefully.

5. Revisions

A consolidated revision round covers reasonable text, caption, photo, and ordering changes—not a new concept, template, interaction, or section. DearEver errors are fixed without using the customer's included round. Additional work may require a separate quote.

6. Review, approval, publication, and hosting

For an accepted paid order, any preview or review step offered as part of manual fulfillment will be shared privately. Publication requires explicit approval and all required payment. An unlisted story is not password-protected and may be opened by anyone who receives its link. Hosting lasts three years from publication, with at least 60 days' notice before planned removal and an opportunity to discuss an extension. Customer-owned domains, password protection, and lifetime hosting are not part of the current package.

7. Cancellations and refunds

Because each story is personalized, the available refund depends on when you cancel and what work has begun.

Before production starts

If you cancel before DearEver begins production, we generally refund the amount paid, less any non-refundable payment-processing cost where applicable and legally permitted.

After production starts

If you cancel after production starts but before the first preview, DearEver generally retains an amount reflecting work completed and refunds the unused portion. For a fixed-price story, this will normally be up to half of the amount paid; the exact amount will be explained for your order.

After a preview or publication

After a first preview has been delivered, or after you approve publication, payment is generally non-refundable because the personalized work has been delivered. We will correct errors on our side without using your included revision round. This does not remove any refund or cancellation right that cannot legally be excluded.

Custom Story deposits

A Custom Story deposit is refundable if you cancel within 48 hours of payment and before scoping or production begins. After that, the same work-completed principles apply. Any balance is due only after preview approval and before publication.

To request a cancellation or refund, email support@dear-ever.com from the purchaser email and include your order reference, reason, and payment date. Approved refunds are sent through the original payment method; processing time may depend on the payment provider.

8. Ownership and marketing

You keep ownership of your submitted content and grant DearEver the limited permission described in the rights policy. DearEver retains ownership of its templates, design, interactions, illustrations, and underlying technology. We will not use your story or photographs in marketing unless you separately opt in. Nothing in these terms limits rights or responsibilities that cannot legally be limited under applicable law.

9. Availability and changes

We may pause or refuse work where content, payment, safety, technical availability, or a requested deadline makes delivery unreasonable. We may use service providers to deliver hosting, storage, email, payment, and security functions.

Material changes will be dated here and communicated where they affect an active paid order. Questions can be sent to support@dear-ever.com.

10. Applicable rights

These terms are subject to the mandatory consumer and other legal rights that apply to you. If a provision is not enforceable in a particular place, the remaining provisions continue to apply to the extent permitted by law.
